Understanding the Dangers of Notario Fraud


I believe immigration law is one of the most challenging and exciting areas of the law, but this week I was reminded of one of the dangers for individuals seeking assistance in this area: notario fraud.  Immigration law is very complex and constantly changing.  It is important for individuals to seek assistance from a licensed attorney experienced in immigration law.  Finding a qualified immigration attorney, however, is not easy.  Our system is full of persons claiming to be immigration “consultants” or “notario publicos.”  These persons are not qualified to represent you in your immigration case and can take advantage of you financially and jeopardize your case.   

One of the recent trends of these “notarios” or “consultants” is promising immigration benefits based on comprehensive immigration reform.  While we all hope for immigration reform in the near future, without a new law, there is nothing immigration attorneys can do on your behalf in anticipation of immigration reform.  We will not know who will benefit from immigration reform unless and until the President signs it into law.   

As a client, there are many steps you can take to ensure that you are receiving assistance from a qualified attorney.  First, make sure you are working with an attorney licensed in the United States.  Ask if the attorney is a member of the American Immigration Lawyers Association (AILA).  This shows the attorney’s dedication to immigration law and the availability of resources at his or her disposal to resolve complex issues.  Second, understand your case.  Your attorney should explain your case to you and the steps that he or she will take on your behalf.   Review any applications filed on your behalf and do not sign an application that contains false claims.  Always ensure you receive a copy of the government filing receipt for each petition or application submitted. 

Finally, if you think you have been a victim of notario fraud, contact someone who can help you.  There are many agencies and organizations willing to help you, including http://www.stopnotariofraud.org.  Or, talk to a licensed attorney about your experience and your options.
